Russian Duma decides to fine migrants rather than deport them

The State Duma Committee on State Construction and Legislation approved for the second reading amendments to the law on the forced expulsion of migrants from Russia. According to the amendments, the expulsion of foreigners can be replaced by fines, Interfax writes.

It follows from the document that the judge has the right to replace the expulsion of a foreigner with a fine. This is possible taking into account the foreign citizen’s attitude towards paying taxes, his availability of housing and law-abiding behavior, as well as taking into account his marital status, type of activity, life expectancy in Russia and other circumstances.

If the judge decides that the penalty of deportation “is an excessive restriction of the right to respect for private life and is disproportionate to the purposes of the administrative penalty, and also in the absence of a state willing to accept a stateless person on its territory,” he may impose an administrative penalty a fine in the amount of 40 to 50 thousand rubles or compulsory work for a period of 150 to 200 hours.

Exceptions may be made in cases where migrants are sentenced under a number of articles of the Administrative Code, which relate to the promotion of non-traditional sexual relationships, gender reassignment, pedophilia, and evading deportation of a foreigner. The judge will have to take these circumstances into account.

A bill to replace the expulsion of foreigners with fines was adopted by the State Duma in the first reading in 2017. It was introduced into the lower house by the government.
