Putin makes it a crime for military to surrender to enemy—up to ten years in prison

The Supreme Court of Russia explained the grounds for considering the surrender of military personnel a crime.

This is reported by  RIA Novosti  with reference to the draft resolution of the plenum of the highest court, which explained the practice of holding citizens accountable for war crimes.

The document states that surrendering with the possibility of resolute resistance is a crime, which is punishable by imprisonment of up to 10 years. Voluntary surrender to the enemy is also considered a criminal act.

At the same time, a serviceman is not subject to criminal liability if he is in a helpless state due to a severe wound or concussion and cannot evade captivity. At the same time, there are a number of conditions under which he can avoid punishment for voluntary surrender: if the crime was committed for the first time, if the serviceman took measures to release and returned to the unit or to the place of service and did not commit other crimes in captivity.

When a military man goes over to the side of the enemy, his actions are qualified under the article on treason, which provides for punishment of up to 20 years in prison.
