Resident of Russia's Jewish Autonomous Region beat her child in drunken stupor
From a resident of the Birobidzhansky district, who in a drunken stupor beat her minor son, the prosecutor's office demands to recover compensation for moral damage in favor of the victim. "The prosecutor of the Birobidzhansky district, acting in the interests of a minor, filed a claim with the district court to recover from a local resident compensation for moral damage caused by the crime.
The appeal to the court in the interests of the minor was preceded by the sending to the court of a criminal case against a 33-year-old resident of the Birobidzhan region, accused of committing a crime under Part 1 of Art. 116.1 of the Criminal Code of the Russian Federation (beating).
It was established that in January 2023, a woman, being in a state of severe alcohol intoxication, in the course of a conflict with her underage son, inflicted bodily injuries on him that did not harm his health (beatings).
During the preliminary investigation of this criminal case, a civil claim for the recovery of moral damages in favor of the minor victim was not filed.
In view of the foregoing, the prosecutor, realizing the provided Art. 45 of the Code of Civil Procedure of the Russian Federation powers, filed a lawsuit in defense of the interests of a minor who, due to age, is unable to independently protect his rights, to recover in his favor compensation for moral damage in the amount of 50 thousand rubles.
